1. Use
You agree that you are at least 18 years of age and are not under the age of majority in your country, state or municipality. This is to help protect minors from views they may be uncomfortable with.
You, the reader, will hereafter be referred to either as a User (one who is simply visiting the site to read, post comments, etcetera) or a Writer (one who contributes content to the site).
2. Conduct
You agree not to post, email, or otherwise make available a post or comment:
a) that is unlawful or threatening, abusive or harassing, invasive of anyone's privacy, or anything that is harmful to minors;
b) that is illegal;
c) that harasses, intimidates or is (in any way) hateful toward an individual or
group of individuals on the basis of their gender, sexual orientation, religion, race, ethnicity, age, or disability;
d) that makes it seem as though you're an administrater and/or moderator for Humanswers;
e) that includes claiming to be someone you are not;
f) that violates a copyright or patent;
g) that constitutes or contains "affiliate marketing," "link referral code,"
"junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited
commercial advertisement;
h) that contains malicious software or viruses;
Additionally, you agree not to:
i) threaten anyone, or be a nuisance to other users;
j) "stalk" anyone or collect information about them in a creepy fashion;
k) use software to download data from Humanswers;
3. Risks of Use (for Viewers and Writers)
a) As any other community website that has the chance of gaining new members, Humanswers may one day run the risk of having misbehaved users on it. You must agree not to take any legal action against Humanswers should you run into any of them. Though rest assured, we'll be fighting with you to eliminate them and ban them from the site forever. Just use common sense and don't talk to anyone that sounds sketchy in any way.
4. Our Rights to Ban People
We reserve the right to ban anyone from Humanswers at any time, for any reason. For users, this may mean deleting your account. Normally, we will almost never do this -- so it shouldn't happen very often at all.
5. Terms of Use for Writers
Writers who upload content to Humanswers or otherwise submit files to its webmaster acknowledge the temporary transfer of copyright necessary for Humanswers to post/sell/distribute that content on their behalf. This includes all copyright ownership necessary to post and distribute the material limited to use here on the site.
In your defense, Humanswers and its Administrator(s) will not share or reproduce your submitted content anywhere else, at any time. Humanswers will pay any writer submitting content for use on the site, where each submitted article will gain a percentage of the site's overall revenue. The popularity of a submitted article will be determined by taking its percentage of overall views from the total views and the resulting ratio will garner a percentage of overall revenue monthly.
Grounds to dismiss you as a writer and withold payment for content submitted include:
a) If you have fraudulently raised the popularity of your content by continually refreshing the page or using any kind of 'autorefreshing' software to have the page reloaded artificially;
b) If you intentionally click ads to raise the site's revenue;
Humanswers' Admin has many ways to track both methods of trying to cheat to gain more revenue, and any writer caught perpetrating them will be subject to dismissal from the site with their earnings/contract renagued.
6. Legal Disputes
You, the User or Writer, agree that any disputes will be governed by the laws of Ontario, Canada - and the jurisdiction of any Court will be in Kitchener, Ontario, Canada.
Humanswers claims immunity from liability to the fullest extent under the law and as provided under the Communications Decency Act for Content provided by third parties and members and nothing in this agreement is intended to waive, remove, or usurp such immunity. You understand and agree that Humanswers may delete any content, messages, photos or profiles (collectively, "Content") that in the sole judgment Humanswers violates the Terms of Use or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Humanswers and/or its members.
You agree to indemnify and hold Humanswers, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above.
